摘要综观慈善事业发达之世界各国,慈善事业的运作多采取两种模式：基金会模式与信托模式。目前我国主要以基金会模式运作慈善事业,相较而言慈善信托明显是跛足前行。与基金会相比,慈善信托具有如设立简便、运行成本低等独特优势。但现实中,由于文化差异、立法制度缺陷等原因,使我国慈善信托在实践操作中困难重重,整体发展滞后。针对这些问题完善与创新慈善信托已经势在必行。加强慈善信托理念的宣传、完善慈善信托的制度供给、激发信托公司从事慈善信托的积极性以及促使慈善信托与基金会融合发展等,是未来完善慈善信托的重要举措。86435

Research On the Development and Problem of China's Public Welfare Trust Model

Abstract Throughout the developed countries in the world of philanthropy, charity operation adopts two modes: foundation model and trust model。 At present, the main operating is foundation, compared with foundation, charitable trust is clearly limping along。 Compared with foundation, charitable trust has it’s unique advantages, for example, setting up is simple and easy and  operation costs is low。 But in reality, due to cultural differences and the legislation defects of system, which makes our charitable trusts difficult in practice and overall development lags for behind。 To solve these problems, charitable trust has been perfect and innovation is imperative。 To strengthen the concept of charitable trust propaganda, improve the system of charitable trust supply, inspire the enthusiasm of trust companies engaged in charitable trust as well as to promote development of charitable trust and fund fusion , is the important measures to improve the charitable trust in the future。

0 引言

慈善事业亦称(公益事业),慈善事业的发展对促进社会财富合理分配、社会公平、社会全面协调发展有一定作用。综观慈善事业发达之世界各国，慈善事业的运作多采取两种模式：基金会模式与信托模式。目前在我国主要以基金会模式为主导运作慈善事业,而西方发达国家如英美国以信托模式构建慈善事业运作模式却最为常见。
