摘要“网络审判”的特点和形成机理进行分析，深刻认识网络审判所带来的不良后果，并针对“网络审判”现象提出相应的对策和化解机制，促进我国公民社会健康有序发展，既是当下社会转型期的现实需求，同时也是我国社会长远发展的保障。本文首先阐述了网络审判的概念、内涵、表现形式和特点，从技术环境、社会环境、舆论环境、司法环境四个方面分析了网络审判产生的原因，提出网络审判的危害主要表现为干扰司法公正、可能损害当事人的正当权利、可能衍生出网络暴力、形成以德代法的人治局面等，在此基础上，从完善网络信息监管的法律法规、加强对公民参与社会事务的引导、积极构建有效的官民沟通机制、加强公民法制教育、提升公民的媒介素养等五个方面提出了未来网络审判的防范策略。87537

Abstract   The characteristics and formation mechanism of“trial”network were analyzed, and the deep understanding network trial brought about by the adverse consequences, and in view of the "network trial" phenomenon, put forward the corresponding countermeasures and resolving mechanism, promote the civil society healthy and orderly development of our country, is not only the realistic requirement of the current period of social transition, is also the guarantee of long-term development of our society。 This article first expounds the concept of network trial, connotation, form and characteristics of the technology environment, social environment, public opinion environment, legal environment four aspects to analyze the causes of the trial network, put forward the harm of network trial mainly for interference of justice, may damage the legitimate rights of the parties, may derive the network violence, forming good for man situation such as generation method, on this basis, from perfecting the network information regulation laws and regulations, strengthen the guide of citizen participation in social affairs, and actively build effective officer people communication mechanism, strengthening the civil legal system education, improve citizen's media literacy puts forward five aspects, such as network trial's defensive strategy in the future。
