摘要:新中国成立后,我国一直主张男女平等理念,平等就业权是民生的基石,而在现实生活中,女性就业平等权的缺失日益明显。就业方面的性别歧视广泛存在,对女性劳动者的歧视屡有发生,严重阻碍了女性就业平等权的实现,亦不利于社会的稳定与和谐,加强宪法方面的女性就业平等就业权的保障,对女性就业平等权的保护和社会的稳定等方面具有重要意义。我们从平等就业权的相关理论出发,分析我国女性就业平等权发展的现状,比如就业歧视及岗位性别歧视的等问题,以及历史、文化和社会的影响而存在女性就业不平等的问题,分析其产生的原因,并结合我国的实际情况,找出不平等原因的法律根源,完善我国女性就业不平等的宪法保护机制,提出进一步完善以宪法为核心的法律体系,并提出制定相关可实施性的法律措施,增加专门法律援助机构,完善监察机制,并通过培养公民在女性就业平等权的权利意识的基础上,以切实实现我国女性就业平等权的宪法保护。39842 毕业论文关键词:女性;就业平等权;歧视;宪法;法律保护
Women Equal Employment Right Protection in China
Abstract :The idea that Men and women should be treated equally (especially about career) was always insisted by our government after the establishment of People’s Republic of China,yet there were many unfair phenomenon like bias to female about work position in the realistic situation.The bias to female in vocation has got really bad influence in many aspects such as the vocational right and social harmony,so to improve the protection of female vocational right at constitution have a profound meaning about it.This thesis begin with the theory about vocational right,analysis the present situation such as position prejudice and gender bias and a series of elements of history ,culture and society.So in order to improve the whole system and improve the situation ,so that we can have a better environment of vocational right,we have to put forward some good rules and add some special department to handle it.
