摘要土地征收是指政府为促进物品利用、增进公共利益，而兴建各种设施，基于政府公权力之作用，依法定程序，取得特定私有物品，并给予当事者相当补偿之行为。我国现在使用的那些关于土地征收的补偿标准本身存在着一些不足，这些不足逐渐变成土地征收过程中的困扰大众的重要问题。87784

本文对我国现行的土地征收补偿标准进行研究,首先对现在土地征收制度的概念、特征和土地补偿标准的现状进行研究,然后参考了美国、加拿大和德国的现行的土地征收补偿标准,通过与之比较研究,指出我国土地征收标准所存在问题及产生这些问题的原因,最后结合外国的土地征收补偿制度、往年的经验以及我国的国情提出了可以促使我国土地征收补偿标准更加完善的一些建议。

Title   The Research of Rural Land Expropriation Compensation Standard           

Abstract Land expropriation is government’s administrative act ,for the obtain of specific private goods according to law ,based on it’s power and。 It promotes the items' use and public interest。 There are some shortcomings hidden behind the current land expropriation compensation system 。 Those would become an important problem puzzling public through the land expropriation。

This paper will discuss on the land compensation standards。 In the first, we will study the concept and feature of Land expropriation ,and the status quo of the expropriation compensation。 On the second, referring to the Land expropriation of USA、Canada and German, point out the problems of the standard of land expropriation in China and reasons due to comparative analysis。 At last ,put forward some suggestions to perfect the compensation standard for land expropriation in China according to foreign expropriation compensation system and experience along with the situation of China。

1  引言

随着我国工业化、城市化进程的加快，尤其是在改革开放之后，我国经济发展得越来越快，每年都有无数农村人口涌入各大城巿，城巿人口数量极速增长，城巿化水平也在快速提高。人口的增长速度远远高于住房增长的速度，因此住房的需求正在快速增长，导致越来越多的农用地被征收成为城市建设用地，在人口密度高的地方更是这样。快速的城巿化以及高速的社会经济发展水平促使我国不断调整土地的利用方式及各种方式所占比重，大量农业用地、未利用地渐渐转化为建设用地，这些事实造成我国失去赖以生存的土地的农民数量持续增长，且引起了一连串的问题。出现的问题大多存在于农民和国家在给予失地农民的征地补款相关事项的矛盾之上，近年来城巿土地公开出让的价格快速飙升，而国家给予失地农民的征地补偿费则往往少于土地出让价格，有的时候甚至低得令人咋舌。因此很多农户不愿意配合征地工作甚至阻挠征地工作的进行，强烈要求获得更多的、更合理的补偿。论文网
