摘要随着我国加入世贸组织，对英文商务合同翻译的研究，将成为翻译工作者的一个重要课题。本文将从词汇，句法等角度的研究英文商务合同，总结英文商务合同的语言特点。词汇层面涵盖专业用语，古体词和正式用语。句法具体分析被动句和长句。在此基础上，本文进一步探讨英文商务合同翻译技巧，总结一般规律，包括长句翻译的内嵌法，倒置法，拆分法；被动句的转换法和顺序翻译法，以求提高英文商务合同的翻译质量。66393

Title A Study on the Language Features of English Business Contract and its Translation 

Abstract

With China’s accession to the WTO, it is certain that the study of contract documents will become an important research topic for translators. As a very important form of communication in international trade, business contract is used to maintain the trading parties’ benefits. This paper analyzes the linguistic features of English business contract and aims to find some relative translation guidelines in order to benefit the future business trade and communication. This paper first analyzes the lexical features including terminology, archaic words and formal words, and then summarizes the syntactic features including passive sentences and long sentences. Finally, this paper provides some relative English business contract translation skills and put forward some suggestions for the further study in this field.

1 Introduction 

Since the reform and opening up, China's economy has become increasingly persified and the economic and trade exchanges with other countries also make a huge development. As a very important form of communication in international trade, business contract is a kind of legally binding text which used to maintain the trading parties benefits. English as the most widely accepted language in the world, is the main language used in the International Business Contracts. Business contracts English is a special language, which covers the characteristics of business English and legal English. Besides, for the enterprises of our country, only to do the work of translation of business contracts well can be set up the bridge with foreign trade freely. In this case, the study on English business contract’s language feature and translation theory is of great concern.

1.1 literature review

In Chinese modern translation theory, the most famous is Fu Lei’s similarity of spirit model and Yan Fu’s 3-character model. Fu Lei introduced his similarity of spirit model, which proposed that practitioners strive for “similarity in spirit rather than in form” (Chen, 2006). In Yan Fu’s 3-character model, the translation criterion is faithfulness, expressiveness and elegance (Deng, 2008). Another influential translator Xu Yuanchong concerns that the objective law of translation is influenced by subjective will, in line with the laws is not necessarily good, out of the laws is not necessarily bad(Li , 2012).
