摘    要 我国《婚姻法》规定，夫妻可以通过签订夫妻财产制契约自由约定财产权属，按照我国《物权法》规定不动产物权的变动经登记始得生效，在调整夫妻间的财产关系时《婚姻法》与《物权法》存在诸多竞合和冲突的地方。夫妻财产制契约因为与夫妻这一身份关系密切相关，所以相比于一般财产协议来说具有身份性，在分析夫妻财产制契约中不动产的物权变动规则时，需同时顾及对当事人意思自治的保护和《物权法》所要求的以登记为生效要件的公式方法，适用于夫妻内部和外部，因为涉及领域不同，应分情况加以讨论。90487
