摘要性是一个古老并且充满“禁忌”的话题,它总是被排斥在主流话题之外。社会发展到今天,我们已经很难否认性对于人类个体和整个人类社会的重要性。然而,受传统观念的影响,人们很难产生自主坚定的性权利意识。脆弱的性权利无处不在,不同于大众的少数人的性取向、性爱好、性行为被排斥、批判,男权主义的社会制度仍然在剥削着女性,科学的性信息没有得到正确的传播,性教育仍然没有得到普及、未得到全面的发展。要加强对性权利的保护,应该从社会的各个方面去考虑,首先需要法律对性权利进行全面地肯定,在这个基础上,发展性教育的理论和实践,并普及性教育以摆脱社会性无知的状态。只有摆脱了普遍的性无知,性权利才有萌发的土壤、发展的动力。我国现行法律在性权利保护问题上存在一些不足,主要在于强奸罪、聚众淫乱罪、军婚制度,以及对淫秽物品的控制等一些相关规定上对公民性权利的保护不够全面、平等。在这些方面,西方发达国家给我们提供了一些借鉴,如全面保护男性性权利、对非公开的自愿的成人的性活动的包容、限制淫秽物品进入未成年人的视线以及较为先进的性教育等。当然每个国家的性文化不同,我国文化在对待性问题上较为含蓄和保守,但同时又受到西方开放文化的影响,如何制定符合本国国情的制度仍然值得商榷和思考。性别划分模式的革新或许可以为社会性别制度的重建提供一种思路,当然,它仍然是一个较为超前的理论,要付诸实践仍需要很长的时间。而社会现状的紧迫性更需要一些见效快的措施来应对性资源的不平衡、性犯罪的横行,性歧视的普遍。30089

Title the Legal Protection on Sexual Rights
Abstract
Sex is an old topic, full of taboo, it is always excluded from the mainstream topics. With the development of the society, it is hard to deny the importance of sex, either for inpiduals or the entire human society. However, because of the influence of the traditional ideas, it is very difficult to generate independent and firm consciousness of sexual rights. The fragile sexual rights are everywhere, the minority of sexual orientation, sexual hobby, and sexual behaviors are excluded, criticized. The female is still under exploitation of patriarchal social system. The sex information has not been spread. The sex education has not been universal or with full development. In order to enhance the protection of sexual rights, we have to consider various aspects. First of all, it needs full affirmation by law. Based on that, we have to develop the theory and practice of sex education, to make it universal and then get out of the status of ignorance to sex. Only in that way, may sexual rights be born and get developed. Our current legal system on the issue of sexual rights protection is quite insufficient, primary on the crime of rape, group licentiousness, military marriage, and the control on pornographic materials. The law is not able to offer sufficient and equal protection to sexual rights. In these respects, western countries have given us some insight, such as the comprehensive protection of men’s sexual rights, the tolerance of adults’ volunteer and nonpublic sexual behaviors, limiting the obscene materials to get into minors’ sight, as well as advanced sex education. Every country has its own culture regarding sex, and ours is relatively implicit and conservative. However, we have been influenced by the western culture, it still remains debatable to establish a system that is suitable for our own situation. The innovation of sex patterns may offer a new idea about the reconstruction of sex system of the society. But it is still a relatively advanced theory, and it needs a long time to be put into practice. The urgency of current situation of society needs some quicker steps to deal with the imbalance of sex resources, the widespread of sexual crimes, and the rampancy of sex discrimination.
