摘   要

中国法律体系形成后，不论在司法实践中还是理论研究上法律方法都面临着新的时代使命。在当前法学研究及法治实践中，需要将法律方法论研究融入中国语境；培育法律人的方法论自觉，形成法律共同体；继续执着于完备而良善的法律方法论体系的建构；检讨法治，坚定文护法治的立场；构建有中国特色的法治体系，实现由法律体系到法治体系跨越。由此，在我国建设法治国家进程中，法律方法应担负起时代使命。

Abstract

After the formation of the Chinese legal system, legal methods in the judicial practice and theoretical research are facing a new mission of the times. Current legal theoretical research and judicial practice need to integrate Legal Methodology into the Chinese context; cultivate the conscious of the legal methodology of jurists, in order to create the formation of the legal community; continue to persist in the construction of a complete and perfect system of legal methodology; review the rule of law, firmly safeguard the position of the rule of law; and to build the rule of law system with Chinese characteristics, so as to achieve the progress from legal system to the rule of law system. Thus, in the process of building a country ruled by law in China, the legal method should assume the mission of the times.
