摘要：罪过形式中间接故意与过于自信过失的区别，被著名德国法学家威尔采尔称为“刑法学中最困难和最具有争议的问题之一”，是刑法理论摆在广大学者面前的一项极富挑战性的研究课题。如果无法准确掌握两者的区别，则不利于保护法益，也不利于保障人权。笔者认为两者的区别主要体现在构成要素---认识因素和意志因素，辅之情感因素。其根源在于对某些概念的混同，且都存在体系上的内在冲突。本文将从案例出发以一般理论为基础具体阐述间接故意与过于自信过失的差异。70507

一、引言

间接故意与过于自信过失的界分是一个模糊的边界，很难准确地把握两者的界分，同时要想从实际解决两者的界分问题更是难上加难。区分两者主要是依据主客观两方面，客观方面是比较容易掌握的，因其客观存在。主观方面虽然说可以根据客观存在的条件进行判断，但终究还是很难捉摸，难以正确把握行为人的心里态度。大多数疑难案件皆源于此。论文网

既然发现了问题，那么就应该正视它，解决它，而并不是一味地去掩盖事实。对间接故意与过于自信过失的界分问题进行深入地探讨与研究，有利于对行为人正确的定罪量刑。本文首先，以我国刑法学中的罪过形式为理论基础，从认识，意志两方面具体分析两者的差异，结合真实案列，贯彻主客观相结合的原则。正视间接故意与过于自信过失的界分问题，尽可能地弥补我国刑法的欠缺，促使法律的完整，保持法律的公平公正。
