摘  要：近年来,我国各地法院先后审理的涉及婚姻的案件中有关夫妻忠诚协议的诉求愈发增多，法院对此类案件作出的判决也是各有不同，裁判中支持与反对并存，这引起了学届对于夫妻忠诚协议的激烈讨论。本文通过分析夫妻忠诚协议的性质与效力学理争议，论证及分析近些年来法院在裁判中对夫妻忠诚协议的适用处理，在此基础上就明确夫妻忠诚协议性质及单独可诉性方面提出建议。77799
