摘要：随着生活水平的快速提高，消费者对消费产品的质量要求日益增加,随之而来的经营者欺诈消费者的不法现象也增多。新《消费者权益保护法》完善了惩罚性赔偿制度，这在一定程度上加大了惩罚性赔偿的深度，对遏制消费领域的欺诈行为起到了一定作用，但并未达到理想的效果。本文试以立法者意图为出发点，对部分争议性问题进行初步分析与探究，并就现今存在的不足从惩罚性赔偿条款适用范围、数额、消费者权益保护诉讼制度以及外部监督机制方面提出相应的完善措施。78161

Discussion of the Punitive Damages System in the Protection of Consumer Rights and Interests

Abstract: With the rapid improvement of standard of living, consumers’ demand in the quality of products is increasing and the illegal phenomenon of operators’ fraud also increase。 New “The protection of Consumer Rights And Interests” has perfected the punitive damages system。 To a certain extent, it increases the depth of the punitive damages and plays an important role in the field of curbing fraud behaviors。 However, it doesn’t achieve the ideal effect。 This article is based on legislators’ purpose。 I try to do the preliminary analysis and investigation on some controversial issues。 Then, I find several disadvantages and give suggestions on the scope of application, the amount，consumer rights and interests protection litigation system and the external supervision mechanisms on the punitive damages system。

新《消费者权益保护法》第五十五条的规定有利于打击不法经营者的欺诈行为，形成秩序井然且充满活力的市场交易氛围。但在立法技术上法律还是不完备的，本文第一部分简述我国《消费者权益保护法》中惩罚性赔偿制度适用的理论基础，第二部分介绍该制度的适用现状，第三部分提出该制度存在以下问题，第四部分分析国外惩罚性赔偿制度在消费者权益保护中适用的状况以及对我国的借鉴意义，第五部分提出完善我国《消费者权益保护法》中惩罚性赔偿制度的建议。
