摘要：合同管理作为建设工程项目管理不可或缺的重要组成部分，已成为与质量管理、进度管理、成本管理并列的一大管理职能。合同管理中稍有失误即会导致工程亏本，承包商如何保障工程施工的顺利完成，争取更大的经济效益，变得越来越具有挑战性。根据国外经验，合同管理产生的经济效益往往大于技术优化产生的经济效益，因此施工企业应该加强合同管理。77529

本文引入案例进行分析，着重研究合同签约管理、情势变更、工期索赔、争议评审解决等合同管理制度中的若干问题。通过研究提出相应方法措施完善合同管理中的一些不足，使得合同更加注重对发包人、承包人市场行为的引导、规范和权益平衡，使与现行法律和其他法律文本更加衔接，保证合同的适用性，促进形成良性交易习惯，有效遏制常见违法违规现象，维护合同当事人的合法权益。同时让承包商如何保证工程施工的顺利完成，争取更大的经济效益，变得越来越具有挑战性，为推动建筑市场健康良性发展起到一些借鉴。
