摘要小产权房指的是在农村集体土地上建设的,销售给集体经济组织以外的单位或个人的,不具有国家发证产权的一类房屋。小产权房长期以来游离于法律监管的范围之外,导致小产权房违规乱建不断加剧。小产权房牵扯面积广泛,涉及到社会各个方面的利益,提出小产权房的解决方案,对加快城镇一体化建设、保障农民利益、保护耕地面积、促进经济持续健康发展、维护社会稳定越来越具有重要的现实意义。51659
本文在对国内小产权房问题研究的基础上,总结了小产权房的基本理论、相关政策,在此基础上归纳了深圳市小产权房的现状以及存在的弊端,主要有:存在法律风险、损害农民利益、侵占耕地和损害国家利益。笔者通过文献分析法、实地调查研究与主成分研究等方法,总结出了导致深圳市小产权房存在的不同原因,其中包括违法乱建,价格低廉、住房保障体制不健全、政府职能缺失、国家征地制度存在问题。最后通过主成分分析法根据深圳市小产权房的成因有针对性的从住房保障制度、政府职能、土地征收制度等方面提出了深圳市小产权房的解决方案。
