摘 要:冒名处分就是行为人冒用他人的身份信息,对他人的不动产进行的一种擅自处分行为。也就是非物之权利人擅自处分原权利人的不动产,将其出卖给第三人,并转移登记。因为冒名处分多是在冒名人与第三人之间当面进行的,因此应将其法律行为关系看作是在冒名人与第三人之间成立。在冒名处分中,行为人是在没有处分权的情况下对他人的不动产实施的处分行为,行为人因没有处分权而构成了无权处分,有适用善意取得制度的可能。在行为人无权处分的前提下,第三人满足了善意不知情,支付了合理价款,双方完成了过户登记等构成要件后即可适用善意取得,取得不动产产权。这是为了保护善意第三人的正当利益,保障交易安全,稳定市场秩序。40123 毕业论文关键词:冒名处分;无权处分;善意取得;不动产登记公信力

Abstract: False punishment is the act of fraudulent use of identity information to others, to the real estate of a person unauthorized disposition. That is,the right person to dispose of the real estate of the original owner without permission, sell it to the third and transfer the registration.Because false punishment is in false between the person and the third person face to face, so should the law behavior as is established in false between the person and the third person.In false disposition, human behavior is in no disposition to others the real implementation of production disposition,human behavior because there is no right to dispose of constitute the unauthorized disposition, may be applied to the system of bona fide acquisition.Under the premise of behavior has no right to dispose, the third person meet the bona fide unaware, paid a reasonable price, both sides have completed the transfer registration form after the elements can be applied in good faith to achieve, to obtain the real estate property. This is in order to protect the trust interests of bona fide third people, maintain the transaction security, and stabilize the market order.
